The petitioner is languishing in custody in a case registered for the offences punishable under Sections 341, 323, 324, 308, 379, 504, 506/34 of the Indian Penal Code.

It is a case of assaulting to the informant and other family members of the informant by all the F.I.R named accused persons including the petitioner. It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. For the alleged occurrence

Patna High Court CR. MISC. No.5225 of 2024(2) dt.07-02-2024 2/2 of 06.09.2023, F.I.R was registered on 08.09.2023 without explaining the delay. There is land dispute between the parties. There is counter version of the occurrence also and petitioner's side also sustained injuries. The petitioner is old person aged about 65 years and he is languishing in custody since 02.11.2023. In contra, learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Biraul, Darbhanga in connection Kusheshwar Asthan P.S. Case No. 309 of 2023.
