The petitioner seeks bail in connection with Darigaon P.S. Case No. 19 of 2024 instituted for the offence under Sections 126(2), 115(2), 109, 352 & 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Section 27 of the Arms Act. 3.

Prosecution case in short is that over a quarrel, petitioner has ordered co-accused, namely Sanni Chaudhary to fire upon husband of the informant. On said order, co-accused has fired upon the husband of the informant and he has sustained injury.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 17-10-2024. Petitioner bears no criminal antecedent/s, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. Learned counsel frankly submits that at the instigation of the petitioner, co-accused fired upon the husband of the informant, due to which he sustained grievous injury. Learned counsel submits that save and except the allegation of giving order, there is no specific allegation against the petitioner. Charge sheet is submitted in this case.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. Petitioner has confessed his guilt in his confessional statement. Other witnesses have supported the prosecution case. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner, there being no direct allegation against the petitioner and charge sheet being submitted, this Court is inclined to grant bail to the petitioner. 8.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with
