JUSTICE SANJAY PRIYA ORAL ORDER 27-09-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Laheriasarai P.S. Case No. 276 of 2018 instituted for the offence under Sections 364 and 379/34 of the Indian Penal Code.
Counsel for the petitioner submits that petitioner has no criminal antecedent.
In the written report it is alleged that Suraj Kumar made call on mobile of son of the informant namely Rahul Kumar requesting him to send an ambulance for going to Muzaffarpur Hospital. Thereafter, son of the informant sent his Scorpio with driver Chaitu Das. It is further alleged that Driver along with Scorpio car was missing.
Petitioner is not named in the written report. The First
Patna High Court Cr.Misc. No.51373 of 2018 (2) dt.27-09-2018 2/2 Information Report is against unknown. The name of petitioner has come during investigation on the basis of confessional statement of co-accused Manish Kumar.
Petitioner is said to be in custody since 01.06.2018. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga at Laheriasarai, in connection with Laheriasarai P.S.
