2. The petitioner is apprehending his arrest in connection with Sasaram (M) P.S.Case No.366/2004, FIR dated 12.08.2024 registered for the offences punishable under Section 304(B)of IPC.

3. Allegation against the petitioner is that he alongwith other co-accused persons have in furtherance of their common intention committed the dowry death of the daughter of the informant.

4. Learned counsel appearing for the petitioner

Patna High Court CR. MISC. No.753 of 2025(4) dt.21-04-2025 2/2 submits that the petitioner has clean antecedent. He has falsely been implicated in the present case. The allegation as alleged in the FIR is false and fabricated and the petitioner has not committed any offence as alleged in the FIR and petitioner has been made accused in the present case merely on the ground that he is husband of the deceased.

5. Learned A.P.P. for the State, on the other hand, has vehemently opposed the prayer for anticipatory bail of the petitioner and submits that it has come during investigation that the petitioner and other co-accused persons after committing the present crime in question disposed of the dead body of the deceased.

6. Considering the aforesaid facts and nature of allegation against the petitioner as alleged in the FIR, I am not inclined to grant privilege of anticipatory bail to the petitioner in connection with Sasaram (M) P.S.Case No.366/2004 pending in the court of learned Chief Judicial Magistrate, Rohtas at Sasaram.
