2. The petitioners seek regular bail in connection with Maner P.S. Case No. 723 of 2023 registered for the offence under Section 379 of the I.P.C.

3. As per prosecution case, it is alleged that the motorcycle of the informant bearing Registration No. BR01BS3166 has been stolen by unknown miscreants which was parked at his door.

4. Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence. Thee petitioners are not named in the FIR. They were arrested with

Patna High Court CR. MISC. No.2335 of 2024(2) dt.31-01-2024 2/2 the stolen motorcycle during vehicle checking. They have falsely been implicated in this case. They have no concern with the alleged seized motorcycle. The petitioners have got no criminal antecedent as stated in para-3 of the bail petition and languishing in judicial custody since 7.10.2023.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody period, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail after framing of charge, if not framed in connection with Maner P.S. Case No. 723 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Danapur.
