====================================================== CORAM: HONOURABLE JUSTICE SMT. SONI SHRIVASTAVA ORAL ORDER 16-07-2025 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 504, 506, 498A of the Indian Penal Code and he is husband of the informant.
3. The matter had earlier been sent to the Patna High Court Mediation Centre for an amicable settlement of disputes. From perusal of the Memorandum of Agreement dated 24.06.2025 passed in the Mediation Proceeding No. 694 of 2025, it would appear that the parties have resolved their issues and entered into an arrangement whereunder the informant

No.89717 of 2024(4) dt.16-07-2025 2/3 along with her children is staying in the first floor of the house and would continue staying there without any objection of any manner. Further, in accordance with Clause 2 of the said agreement, it is submitted on behalf of the petitioner that he undertakes to take care of the educational expenses of the children and the day to day expenses of the informant also.
4. At this stage, in order to show his bona fide, the petitioner agrees to deposit an amount of Rs. 2,000/- (two thousand) per month in the account of the informant for her sustenance.
5. Learned counsel appearing for the informant, however, supports the said agreement with the only prayer that the expenses of the informant and the children be taken care of.
6. In view of the settlement and also offer made on behalf of the petitioner, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Sultanganj P.S. Case No. 146 of 2024, subject to the condition as laid down
Patna High Court CR. MISC. No.89717 of 2024(4) dt.16-07-2025 3/3 under Section 438 (2) of the Cr.P.C/ 482 (2) of the B.N.S.S., 2023.
7. It goes without saying that the aforesaid payment shall be subject to any order being passed in matrimonial maintenance case or any other collateral proceedings.
8. Learned counsel for the informant is directed to furnish the bank account details of the informant in the learned Court below. If the informant fails to furnish the same, the aforesaid amount will be deposited in the learned Court below which will be released in favour of the informant after she furnishes her bank account details. If the petitioner fails to pay the aforesaid amount on two consecutive months, the informant shall be at liberty to move before the learned Court below for cancelling the bail bond of the petitioner.
9. Accordingly, this application stands disposed of.
10. However, it is expected that both the parties would strictly adhere to the terms and conditions as agreed by them in the settlement.
