2. This application, for grant of anticipatory bail, arises out of Dehri Police Station Case No. 502 of 2024, disclosing offences under Sections 115(2),126(2), 118(2) of the Bharatiya Nyaya Sanhita.

3. The prosecution case, as per the First Information Report, is that on 20.07.2024 at about 06:00 P:M, while the informant was coming towards his home from Kesho auto Mobile Agency, he was assaulted by the petitioner and co-accused Krishna Kumar (son of the petitioner). The co-accused Krishna Kumar assaulted informant by sharp cutting weapon and the petitioner assaulted him by fist, legs and slaps.

4. Learned Counsel for the petitioner submits that petitioner has falsely been implicated in this case due to local

Patna High Court CR. MISC. No.440 of 2025(2) dt.06-02-2025 2/2 rivalry. He further submits that both the parties are neighbours and agnates also. He next submits that the injury sustained by the informant is simple in nature as it would be evident from the injury report annexed at Annexure P/2. He further submits that the allegation of assault against the petitioner is by fist, legs and slaps.

5. Having regard to the submissions made on behalf of the parties and taking into consideration the nature of allegation and the fact that both the parties are agnates and neigbours, I am inclined to grant the petitioner privilege of anticipatory bail.

6. This application is, accordingly, allowed.

7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Dehri, Rohtas at Sasaram in connection with Dehri (Town) Police Station Case No. 502 of 2024, subject to the condition laid down under Section 482 of the Bharatiya Nyaya Sanhita.
