====================================================== CORAM: HONOURABLE MR. JUSTICE SANDEEP KUMAR ORAL ORDER 23-02-2024 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the Union of India.
2. The I.O. of the case has appeared. He submits that the trial shall be concluded within 2-3 months as new Special Court for the trial of NDPS cases has also been constituted and now the trial is proceeding.
3. The recovery is huge and in these circumstances, I am not inclined to grant bail to this petitioner for the present in connection with Special (NDPS) Case No. 7/19. This application is dismissed.
4. The trial is directed to be concluded within three months from today failing which this Court will consider the
Patna High Court CR. MISC. No.1320 of 2024(4) dt.23-02-2024 2/2 bail application of the petitioner in view of the judgment of the Supreme Court in the Case of Md. Muslim @ Hussasin Vs. State (NCT of Delhi) reported in 2023 SCC Online SC 352.
5. The Special Judge is directed to conclude the the trial at the earliest. The I.O. will take personal interest in the matter so that the petitioner is not detained any further as under trial.
6. Let a copy of the order be communicated to the District Judge, Patna through FAX/e-mail forthwith for compliance of the order.
