JUSTICE SANJAY PRIYA ORAL ORDER 08-10-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Pipra P.S. Case No. 138 of 2015 instituted for the offence under Sections 302 and 201/34 of Indian Penal Code pending in the court of Shri J. Kumar, Additional Chief Judicial Magistrate-IIIrd, Supaul. Petitioner is husband of the deceased.

It is alleged in the written report that petitioner who is brother-in-law of the informant (Bahnoi) used to commit torture with the deceased. It is further alleged that petitioner gave information to the informant that his sister is serious. The informant went to Referal Hospital and found his sister lying dead. He learnt from the Doctor that his sister has been poisoned to death. The dead body has been disposed off before arriving the

Therefore, this Court is not inclined to grant bail to the petitioner at this stage.

Prayer for bail of the petitioner stands rejected. Petitioner may renew his prayer for bail after nine months.
