2. This is an application for anticipatory bail on behalf of the petitioner for the offences alleged under Sections 379 and 411 of the Indian Penal Code registered in connection with Aurangabad Town P.S.Case No. 400 of 2024.

3. As per allegation, the informant in course of investigation of another case, noticed a miscreant riding a cycle. He was asked to halt, but started beating a hasty retreat. The informant, however, managed to overpower him. From his possession, an old iron engine and a Samsung mobile phone were recovered.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in

Patna High Court CR. MISC. No.90030 of 2024(2) dt.21-02-2025 2/2 this case. Nothing was recovered from his possession. He is a person of clean antecedent. Co-accused Ankit Kumar, on whose confessional statement, the name of the petitioner has figured, has been granted bail by this Court.

5. On the other hand, the learned APP for the State has opposed the prayer for bail.

Considering the above-mentioned facts and circumstances especially the clean antecedent of the petitioner, let the petitioner, in the event of his arrest or surrenders within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Motihar, Auurangabad in connection with Aurangabad Town P.S. Case No. 400 of 2024, subject to the conditions as laid down under Section 438(2) Cr.P.C.
