Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 307, 504, 506/34 of the Indian Penal Code. Allegation against the petitioners is to have assaulted the informant by lathi and arms.

It has been submitted that petitioners are innocent and have been falsely implicated in this case due to village rivalry and previous enmity. Allegation against the petitioners are general and omnibus and no specific allegation of assault has

Allegation of assault is against accused Raj Kumar Mahto, Ganesh Mahto and Ramdeo Mahto, who are not the petitioners. There is admitted land dispute between the parties. There is case and counter case. Petitioners have no criminal antecedent.

Considering the facts and circumstances of the present case, let petitioners, above named, in the event of arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 20,000/- (Twenty thousand only) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending in connection with Simultala P.S. Case No. 35 of 201,9 condition as laid down under Section 438(2) of the Code of Criminal Procedure.
