This is an application for regular bail in connection with Warisaliganj P.S. Case No. 242 of 2018 registered for the offences punishable under Sections 448, 341, 323, 504, 384 and 34 of the Indian Penal Code.

Informant alleged that when he was at his house petitioners along with other co-accused persons entered into his house and demanded Rs. 2,00,000/- as Rangdari and on refusal, they started assaulting him and also assaulted with knife due to which he sustained injury and when his Natin Anjali Mishra and daughter came to save him, the petitioners and other accused persons assaulted them and also snatched golden chain and cash

Patna High Court Cr.Misc. No.52381 of 2018(2) dt.28-09-2018 2/2 from his daughter and on raising alarm petitioners and other accused persons fled away.

It has been submitted on behalf of the petitioners that petitioners are innocent and have been falsely implicated in this case. It has been further submitted that there is general and omnibus allegation against petitioners. There is dispute for the joint family property and in this regard a partition suit No. 28 of 2016 is pending between the parties. Petitioners have no criminal antecedent and they are in custody since 19.07.2018. Considering the facts and circumstances of the case, let above named petitioners be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-II, Nawada, in connection with Warisaliganj P.S. Case No. 242 of 2018.
