08-10-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is seeking anticipatory bail in connection with Kotwali P.S. Case No. 163/2017 registered under Sections 420, 34 of the Indian Penal Code, pending in the court of learned Chief Judicial Magistrate, Munger. Learned counsel for the petitioner submits that petitioner is a student and the mobile number from which the call was made to the informant does not belong to the petitioner. Learned counsel however does not deny the fact that a sum of Rs. 5,04,336/- was deposited in the account of the petitioner on different dates.
Learned Additional Public Prosecutor for the State opposes the prayer of anticipatory bail of the petitioner.
Patna High Court Cr.Misc. No.53202 of 2018 (2) dt.08-10-2018 Considering the facts and circumstances of this case wherein the link of the alleged occurrence has been prima facie shown with the present petitioner, this court is not inclined to extend the benefit of anticipatory bail to the petitioner.
Accordingly, prayer for anticipatory bail of the petitioner is rejected.
In case, the petitioner surrenders in the court below within a period of four weeks from today and prays for regular bail, his application shall be considered by the court below on its own merit on the basis of the materials available on the record.
