The petitioner apprehends his arrest in connection with Kochas P.S. Case No. 170 of 2016 registered under Sections 8(C), 20(B), 22, 27(A) of the N.D.P.S. Act On receiving secret information about business of illicit liquor at the house of Pradeep Kumar at Mohalla Gabndhi, Nagar Mohania Road, Kochas, the informant along with other police officials reached there. In course raid, Pradeep Kumar was apprehended and 7 K.G. Ganja kept in two bags recovered. On query, Pradeep Kumar disclosed that his brother, Santosh Sah used to sell the Ganja in his Gumti.

Learned counsel for the petitioner submits that

Patna High Court Cr.Misc. No.53624 of 2018(4) dt.11-12-2018 2/2 petitioner, is not named in the F.I.R. but in course of investigation, petitioner, who is brother of Pradeep Kumar and Santosh Sah, has falsely been implicated mere on suspicion. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge-cumSpecial Judge, NDPS, Rohtas at Sasaram, in connection with Kochas P.S. Case No. 170 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
