2. This is the second attempt on behalf of the petitioner for grant of regular bail. Earlier, the prayer of the petitioner for grant of bail has been rejected by a co-ordinate Bench of this Court vide order dated 16.01.2024 passed in Cr. Misc. No. 77785 of 2023.

3. The petitioner has preferred this application for grant of regular bail in connection with Hajipur Sadar P.S. Case No. 684 of 2022 registered for the offences punishable under Sections 302, 307, 341, 323, 504, 506, 147, 148 and 149 of the I.P.C.

4. As per the prosecution case, On 28.08.2022 at about 5 P.M., the informant along with his son went to demand due money of Rs. 5,000/- from Mani Singh (the petitioner). It is further alleged that the petitioner stabbed the son of the informant upon his chest by means of Knife causing grievous

5. Learned Senior Counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It is further submitted that during the course of trial only two witnesses have been examined till date and the first witness was examined in May 2024, while the second witness was examined in September 2024, and till date no other prosecution witness has been examined. Learned Senior Counsel has brought the attention of this Court to the report sent by the learned trial Court and from perusal of the same, it appears that till 11.03.2025 only two prosecution witnesses have been examined and warrant of arrest has been issued against rest of the prosecution witness. It is lastly submitted that the petitioner has clean antecedent and is in custody since 06.11.2022.

6. Learned APP for the State has vehemently opposed the prayer for bail and stated that the petitioner was the main assailant. It is further stated that the post-mortem report of the deceased corroborates the prosecution case and several injuries were found on the body of the deceased, hence, he does not deserve the liberty of bail.

7. Having heard the learned counsel for the parties

Patna High Court CR. MISC. No.1495 of 2025(6) dt.02-07-2025 3/3 and considering the aforesaid facts, this Court is not inclined to grant bail to the petitioner and the same is hereby rejected.

8. This Court is constrained to record that despite ample opportunity and direction of this Court passed on 16.01.2024 in Cr. Misc. No. 77785 of 2023, wherein the trial Court was directed to expedite the trial and conclude the same at the earliest, till date only two prosecution witnesses have been examined.

9. The learned trial Court is directed to ensure that the trial proceeds on day-to-day basis and looking at the delay in producing the prosecution witnesses, the Superintendent of Police, Vaishali at Hajipur is directed to produce the official witnesses.

10. It is further observed that the trial of the present case be completed within a period of six months from today, without unnecessary adjournments being granted to either side.

11. Let a copy of this order be communicated to the Superintendent of Police, Vaishali at Hajipur through FAX for its compliance forthwith.
