====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 18-12-2019 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in a case for the offence registered under Sections 354, 354(D), 376/511, 504 and 506 of the IPC.

The prosecution story, in brief, is that the informant was working as Teacher in 'Jeevan Public School' and her child was also studying in the said school and Vishal Gaurav (petitioner) was also working in I.T. Department in the said school. On 15th May, 2019, she was celebrating her marriage ceremony in which Vishal Gaurav (petitioner) was also invited and at that time, she was looking very nice and this petitioner has evil eyes upon her. The petitioner started misbehaving with her and doing bad act. She reported this matter to her husband. On 10.10.2019 at 7.00 P.M., this petitioner came to her house and asked to make undress. Due to this act, she was very shocked and phoned to her husband as well given an information to the S.H.O., Chhatauni. When she informed to her husband and S.H.O. this petitioner snatched her Mobile and started assaulting her and pushed her on bed and tried to commit ill act, in the meantime, the police came and caught this petitioner on spot. This petitioner threatened to defame her in future.

It has been submitted by learned counsel for the petitioner that the petitioner is in custody since 11.10.2019. The petitioner has got no criminal antecedent. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The petitioner and the informant were working in the said Institution and due to personal differences in the said Institution, the present case has been instituted. The petitioner denies to attend the marriage anniversary celebration of the informant. The allegation made in the F.I.R. is denied by the petitioner.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Motihari, East Champaran in connection with Chhatauni P.S. Case No. 448 of 2019.
