JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-01-2020 Petitioner seeks regular bail in connection with Kishanganj P. S. Case No. 579 of 2018 registered for the offences punishable under Sections 302, 253, 388, 34 of IPC and Section 3⁄4 of Explosive Substance Act and Section 27 of the Arms Act.

As per prosecution case, while the police personnel on patrolling and when they reached near the godown of Nand Kishore Agarwal, there was firing by the petitioner and other accused persons, causing injury to the deceased. Submission of the learned counsel for the petitioner is that he has falsely implicated in this case and accused persons have already been granted bail, vide order dated 23.01.2020 passed in Criminal Misc. No. 4639 of 2020 as well as vide order dated 28.08.2019 passed in Criminal Misc. No. 34645 of 2019. Further submission is that he is in custody since 13.09.2018.

Having heard both sides, in view of the submissions, made above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Additional Sessions Judge-I-cum-Special Judge, Kishanganj, in connection with Kishanganj P. S. Case No. 579 of 2018, subject to the condition that he has to appear before the learned trial court as and when required, otherwise, his bail bonds shall be cancelled.
