2. The petitioner seeks bail in connection with Warisnagar (Mathurapur O.P.) P.S. case No. 326 of 2023 instituted for the offences under Sections 363, 366, 494 of the Indian Penal Code.
3. Prosecution case, in short, is that this petitioner, who is the cousin of informant, has illicit relations with the wife of the informant. It is further alleged that this petitioner fled
Patna High Court CR. MISC. No.6897 of 2024(4) dt.08-05-2024 2/3 away with the wife of the informant by luring her in the pretext of marriage.
4. Learned counsel for the petitioner submitted that the petitioner has falsely been implicated in the present case. Learned counsel further submitted that this petitioner is the cousin brother of the informant. He further submitted that this case has been lodged due to misunderstanding and wrong information received by the informant. He further submitted that the wife of the informant is major aged about 28 years. Learned counsel further submitted that victim, in her statement recorded under Section 164 of the Cr.P.C. has not whispered anything about this petitioner. It has been submitted on behalf of the petitioner that the petitioner is in custody since 21.09.2023 and has no criminal antecedent.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the aforesaid facts and circumstances of the case, as also the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.
7. Let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Court
