JUSTICE BIRENDRA KUMAR ORAL ORDER 12-12-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is languishing in custody in connection with Gangabridge P.S. Case No.110 of 2017, a case under Sections 8/20(b)(ii)(c)/25/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985.
The petitioner was driver of the pick-up from which 145 Kgs. of ganza was recovered. The petitioner is in custody since 08.09.2017.
This Court had earlier refused the prayer for bail on 08.02.2018, vide order at Annexure-1, with direction to the learned trial Judge to expedite the trial.
The report of the trial Judge would reveal that two
Patna High Court Cr.Misc. No.53726 of 2018(3) dt.12-12-2018 2/2 prosecution witnesses have already been examined. The trial-court is directed to proceed with the trial by fixing the case on short adjournments as per the mandate of the provisions of the Code of Criminal Procedure and conclude the same preferably within six months.
With the aforesaid observation, the prayer for bail is refused.
