The petitioner is languishing in custody since 23.10.2019 in a case registered for the offences punishable under Sections 272 and 273 of the I.P.C. and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The prosecution case is that 70.200 litres Nepali liquor was recovered from the possession of the petitioner. It is submitted by learned counsel for the petitioner that the petitioner has been roped in the present case for the first time. Statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent. Learned APP submits that the recovery has been made from the possession of the petitioner.

Considering the quantity of recovery, statement made
