The petitioner seeks bail in connection with Sarai P.S. Case No. 114 of 2018, registered under Sections 414 and 413/34 of the Indian Penal Code.

The accusation is that six persons, including the petitioner, were apprehended by the villagers along with three motorcycles with allegation that all the six persons had gone to sell the theft motorcycle.

Learned counsel for the petitioner submits that, in fact, petitioner was going to his village Sarai boarding on motorcycle bearing Chassis No. MD2A11CY2JRA19331, Engine No. DHYRJA42325 purchased by his friend Raju Kumar, but due to misconception, the petitioner was also apprehended

Patna High Court Cr.Misc. No.53871 of 2018(2) dt.19-09-2018 2/2 by the villagers along with other accused. The petitioner has no criminal antecedent is in custody since 06.06.2018. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur in connection with Sarai P.S. Case No. 114 of 201. Out of two sureties, one surety must be the parent/close relative of the petitioner.
