The petitioner seeks bail in Excise Case No. 682 of 2019 registered under Sections 30(a) of Bihar Prohibition and Excise Act, 2016.

Having no criminal antecedent it is submitted that the petitioner is in custody since 19.10.2019 on false implication in the case arising out of alleged recovery of 2000 litres of illicit liquor from the Tata 407 vehicle.

Counsel for the petitioner submits that he was performing professional duty as Khalasi and neither owner of the vehicle or consignor of the goods. He had no knowledge about the contents of the vehicle. There is nothing on record to connect the petitioner with the alleged recovery.

Considering the aforesaid submissions the petitioner's prayer for bail is allowed. Let the petitioner above named be released on bail on his furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise Gaya in Excise Case No. 682 of 2019 on the

No.81111 of 2019(2) dt.16-01-2020 2/2 following conditions:- (i) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner. (ii) That the petitioner will be well represented on each date in the trial and if he fails to do so on two consecutive dates, his bail will be liable to the cancelled.
