The petitioners are apprehending their arrest in a case registered under Sections 147, 148, 341, 342, 307, 353, 435, 427, 120B of the Indian Penal Code and Section 17 of the C.L.A. Act.

Accusation is that the petitioners being members of the mob attacked the police personnel, pelted stones causing injury and put the vehicle on fire.

It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the

Patna High Court Cr.Misc. No.53496 of 2018(3) dt.05-10-2018 2/2 petitioners. The petitioners have been made accused due to mistake of fact. General and omnibus allegation has been made against the petitioners. No specific overt act has been alleged against the petitioners. Other co-accused have been granted bail vide Annexure-2 and 3 to the present application. On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Sherghati, Gaya in connection with Dumaria P.S. case No.37 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
