The petitioner seeks bail in connection with Narari Kala Khurd P.S. Case No.40 of 2019 registered for the offence under Sections 380, 366, 368, 379, 372, 376 of the Indian Penal Code.

Accusation is that while the informant Pintu Chaudhary used to live in Kerala for the purpose of his livelihood, the petitioner, who is brother of the informant's Sarhu, had been visiting the house of the informant and used to entice the wife of the informant and established physical relation with his wife. Ultimately, the petitioner kidnapped the wife of the informant with intention to get married on 20.02.2019 and took away his

Submission is that wife of the informant in her statement recorded under Section 164 of the Code of Criminal Procedure on 16.11.2019 denied about the allegation made in the F.I.R.. She has further stated that she had gone to her Maike on her own volition. The petitioner has no criminal antecedent and he is in custody since 16.11.2019.

Considering the facts and circumstance, let the petitioner above named be enlarged on bail on furnishing bail bond of Rs.10,000/-( ten thousand ) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Narari Kala Khurd P.S. Case No.40 of 2019.
