The petitioner apprehends his arrest in connection with Bagaha (Pathkhauli) P.S. Case No. 270 of 2018 registered under Section 379 of the Indian Penal Code.

The accusation is that the tractor of the informant, which was purchased on loan, was taken by Prem Singh, Pappu Yadav, Vijay Sah and Ajay Ram introducing themselves as agent of Magma Financer. When the informant went at Motihar Office then Manoj Choudhary told him that there was no direction to seize the tractor. Thereafter, informant contacted Prem Singh then Prem Singh disclosed that in the way, the tractor was snatched by Uma Yadav, Yogendra Yadav (petitioner), Herinarayan Yadav.

No.54825 of 2018(2) dt.11-12-2018 2/2 Learned counsel for the petitioner submits that, in fact, allegation has been made against the petitioner and his two brothers to snatch the tractor of the informant, which was being carried by the Agents of Magma Financer. It is further submitted that due to enmity, Prem Singh disclosed the name of petitioner and his two brothers snatching the tractor of the informant. It is further submitted that similarly situated co-accused, Harinarayan Yadav, has already been granted privilege of bail by a Bench of this Court vide order dated 09.10.2015 passed in Criminal Misc. No. 51947 of 2018.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M., Bagaha, West Champaran, in connection with Bagaha (Pathkhauli) P.S. Case No. 270 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
