ANJANA MISHRA ORAL ORDER 05-03-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 03.08.2017 in connection with Allouli P.S. Case No.202 of 2017 (G.R. No.1894 of 2017) registered for the offences under Sections 392 and 411 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that save and except the confessional statement recorded by the police, there is no other material in the case diary so as to connect the petitioner with the offence. Learned counsel for the petitioner further submits that such confessional statement made before the police has no evidentiary value. It is submitted that the alleged recovery

Patna High Court Cr.Misc. No.8208 of 2018 (3) dt.05-03-2018 2/2 was made from the joint possession of the petitioner and coaccused Ketan Yadav and as such, the petitioner alone cannot be held liable for such recovery.

Considering the entire facts and circumstances and upon consideration of the fact that the petitioner has got no criminal antecedents, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria, in connection with Allouli P.S. Case No.202 of 2017 (G.R. No.1894 of 2017).
