The petitioner seeks bail in Araria P.S. Case No. 08 of 2017 registered under Section 395 of the Indian Penal Code. Five motorcycle borne criminals are said to have looted cash and belongings of the informant near railway gate. It is submitted by learned counsel for the petitioner that the petitioner is neither named in the F.I.R. nor any incriminating article has been recovered from his conscious physical possession. There is nothing in the record indicating the complicity of the petitioner in the occurrence barring confessional statement of the co-accused Dilip Yadav and the petitioner which
Patna High Court Cr.Misc. No.9554 of 2018 (3) dt.16-03-2018 2/2 has no evidentiary value in the eye of law. The petitioner has no criminal antecedent. He has been languishing in custody since 26.11.2017.
In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Araria P.S. Case No. 08 of 2017.
