The petitioner in the present case is seeking regular bail in connection with Barhara P.S. Case No.357 of 2019 registered for the offence punishable under Sections 341, 323, 307, 504 and 506 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Learned counsel submits that there is no specific allegation of assault against this petitioner.

Learned APP has opposed the prayer for bail.

Considering the facts and circumstances of the case wherein there is a case and counter case, the sister of the petitioner has lodged one FIR alleging that the informant's side had indulged

No.84540 of 2019(2) dt.19-12-2019 2/3 in teasing her and had torn her clothes and thereupon a fight took place between both the parties, though it appears that the informant of this case is said to have got injury on his head, but in the impugned order it has come that he was discharged from PMCH and it has not been stated that the injury is grievous in nature, consdiering the nature of allegation and the age of the petitioner being only 19 years and that he is a student and the scuffle seems to have taken place in course of tuition and returning from there as also that the petitioner has no criminal antecedent and has remained in custody since 13.10.2019, the investigation against him is complete and charge-sheet already filed, let the petitioner above named be released on bail on furnishing bail bond of Rs.

15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhojpur at Ara in connection with Barahara P.S. Case No.357 of 2019, subject to the condition as laid down under Section 437 (3) Cr.P.C.
