The petitioner seeks regular bail in connection with Hulasganj P.S. Case No. 148 of 2018, registered for the offence punishable under Sections 25(1-b)a, 26 and 35 of the Arms Act.
The allegation is regarding recovery of illicit arms and live cartridges from the co-accused persons and the name of the petitioner is stated to have transpired in the present case upon confessional statement made by the arrested co-accused person. The learned counsel for the petitioner has submitted that admittedly, no recovery of illicit arms / live cartridges has been made from the petitioner, hence, no complicity of the
Patna High Court CR. MISC. No.83025 of 2019(2) dt.13-12-2019 2/2 petitioner can be said to be present as far as the present case is concerned. It is further submitted that the petitioner is having a clean antecedent and he is languishing in custody since 26.9.2019.
Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.
Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Jehanabad in connection with Hulasganj P.S. Case No. 148 of 2018.
