Mr. Dilip Kumar No. 1, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 12-01-2026 Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. Petitioners apprehend their arrest in a case instituted under Sections 126(2), 115(2), 118(1), 303(2), 109, 351(2) and 3(5) of the B.N.S.

3. As per prosecution case, petitioner nos.1 and 2 assaulted the informant with sword due to which the informant sustained head injury. Meanwhile petitioner no.3 Tanu Kumari gave iron blow on the mouth of informant as a result of which his bone of nose was broken. It is further alleged that petitioner

Patna High Court CR. MISC. No.87613 of 2025(2) dt.12-01-2026 2/3 no.1 snatched a chain made of gold from the neck of informant. Petitioner no.4 is alleged to have tied a rope around the neck of informant.

4. Learned counsel for the petitioners submits that petitioner no.3 Tanu Kumari had earlier filed one criminal case against the prosecution side vide Sangrampur P.S. Case No.150 of 2025 and to make pressure to compromise the earlier case, the informant entered the room of petitioner no.3, locked her and assaulted her. For the said occurrence, there is case and counter case between the parties. The injured got injury on the nasal bone which is not caused the petitioners. Petitioner no.2 and petitioner no.3 are girls aged about 23 and 22 years respectively whereas petitioner no.1 is aged about 27 years and petitioner no.4 is aged about 18 years having no criminal antecedent. Petitioners undertake to cooperate in the investigation and trial.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioners be released on bail on furnishing bail
