2. The petitioner seeks regular bail in a case registered for the offence under Sections 457/380 of the Indian Penal Code.
3. As per the prosecution case, the petitioner is accused of committing theft in the house of the informant and recovery has been made from the petitioner.
4. Learned counsel for the petitioner submits that the petitioner is in custody since 19.08.2023. He is quite innocent and has not committed any offence.
5. Learned A.P.P. has vehemently opposed the prayer for bail.

6. Considering the facts and circumstances of the case, this application for regular bail is allowed.
7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar/concerned Court below in connection with Brahmpur P.S. Case No. 458 of 2023 subject to the condition that:- 7(1). The petitioner will mark his attendance at the Bihiya, Bhojpur Police Station on every Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
