2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 406, 420 and 468 of the Indian Penal Code.
3. As per the complaint case, this petitioner got property of his father transferred in his name on the basis of forged thumb impression of the complainant.
4. Learned counsel for the petitioner submits that petitioner is own brother of the complainant and due to partition dispute, this false and concocted case has been lodged against
Patna High Court CR. MISC. No.1883 of 2024(2) dt.07-02-2024 2/2 him. Police after investigation submitted final form. However, on protest petition filed by the complainant, court below has taken cognizance.
5. Learned counsel for the complainant vehemently opposes the bail application.
6. Considering the facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-I, Muzaffarpur in connection with Complaint Case No. 1608 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
