The petitioner has filed the instant application for grant of anticipatory bail apprehending his arrest in a case registered for the offence under sections 341, 323, 307, 379, 406, 498(A) and 34 of the IPC.

As per allegation in the complaint, the allegation against the accused persons including this petitioner is of demand of dowry, cruelty and misbehaviour with the daughter of the complainant.

It is submitted by learned counsel for the petitioner that he is the son-in-law of the complainant. On the petitioner coming to know about the insanity of his wife, he filed Divorce

Patna High Court CR. MISC. No.81047 of 2019(2) dt.10-12-2019 2/2 Case No.236 of 2018. It was much thereafter in the year 2019, i.e. on 27.04.2019 that the instant complaint was filed and the same has been registered as the FIR.

Having heard in the facts and circumstances of the case, especially on the ground of filing of divorce case filed by the petitioner in the year 2018 itself, the court is inclined to enlarge the petitioner on bail. The petitioner above named, in the event of his arrest or surrender in the court below within a period of six weeks from today in connection with Sahajitpur P.S. Case No.69 of 2019 (arising out of Complaint Case No.1039 of 2019) is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, VIth, Saran at Chapra subject to the conditions as laid down in section 438(2) of Criminal Procedure Code.
