ANJANA MISHRA ORAL ORDER 14-03-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner has been in custody since 26.08.2017 in connection with Bhabhua P.S. Case No. 528 of 2017 registered for the offences punishable under Section 366 of the Indian Penal Code.

Learned counsel for the petitioner submits that in the trial which has ensued on completion of the investigation, the mother of the victim girl who has lodged the present case has deposed in the trial that she had mistakenly filed the case against the petitioner and that she has compromised the matter. In view of the fact that the girl in question had not eloped with the petitioner, it has been further stated in her deposition that she had filed the case on pure suspicion.

No.11955 of 2018 (3) dt.14-03-2018 2/2 Considering the deposition made by the informant herself in the trial and that the petitioner has already been in custody since 26.08.2017, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge, - 1st, Kaimur at Bhabhua, in connection with Bhabhua P.S. Case No. 528 of 2017.
