JUSTICE MADHURESH PRASAD ORAL ORDER 05-04-2018 Heard learned counsel for the petitioners and learned APP for the State.
This is a case registered under Sections 304(B)/34 of the Indian Penal Code.
It is submitted on behalf of the petitioners that there are general and omnibus allegations against the petitioners and no specific allegation has been attributed against them. The petitioners are mother-in-law and father in law of the victim. He further submits that the husband is in custody in connection with this case. It is also submitted that the family members of the accused have duly informed the informant's family who have reached the place of occurrence and found the body of the deceased there which shows bonafide conduct of the accused
Patna High Court Cr.Misc. No.11816 of 2018 (3) dt.05-04-2018 2/2 persons. The petitioners having no criminal antecedent are in jail custody since 28.11.2017 and 27.10.2017.
In the facts and circumstances of the case, prayer for bail of the petitioners is allowed. Let the petitioners above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Siwan in Darauli P.S. Case No. 82 of 2016 subject to the conditions : (i) That one of the bailors will be a close relative of the Petitioners who will give an affidavit giving genealogy as to how he is related with the Petitioners. The bailor will also undertake to inform the Court if there is any change in the address of the Petitioners.
(ii) That the Petitioners will be well represented on each date and if they fails to do so on two consecutive dates, their bail will be liable to be cancelled.
