ANJANA MISHRA ORAL ORDER 24-01-2020 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending her arrest in connection with Lakhisarai (Kabaiya) P.S. Case No.448 of 2018 registered for the offence punishable under Sections 272, 273 of the Indian Penal Code and Sections 30(a), 32(b), 36(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner is the owner of the tempo vehicle, which has been placed for public transportation by the petitioner. It is further submitted that the alleged recoveries were not from the conscious possession of the petitioner but from the tempo. It is further submitted that the petitioner is not having any criminal antecedents.

No.82119 of 2019(2) dt.24-01-2020 2/2 Considering the aforementioned facts and circumstances, let the petitioner, above named, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-2nd-CumSpecial Judge, Excise, Lakhisarai, in connection with Lakhisarai (Kabaiya) P.S. Case No.448 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
