JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-12-2019 Petitioner seeks regular bail in connection with Kajra P.S. Case No. 61 of 2018 registered for the offences punishable under Sections 147, 148, 149, 353, 307 of the Indian Penal Code and Section 27 of the Arms Act.

As per F.I.R., police on secret information of gathering of several persons including petitioner for committing heinous crime, raided the village Barmasiya. There was firing by the miscreants who have been chased by the police, several cartridges, detonotors and other articles have been recovered. Petitioner is also named in the F.I.R. and apart from which he is accused in two other cases.

Submission of learned counsel for the petitioner is that except he is named in the F.I.R., no specific allegation has been attributed against the petitioner and the other co-accused

Patna High Court CR. MISC. No.80674 of 2019(2) dt.10-12-2019 2/2 has been granted privilege of anticipatory bail by a co-ordinate Bench of this court vide order dated 07.08.2019 passed in Criminal Misc. No. 49373 of 2019. Petitioner is in custody since 03.08.2019 and charge sheet has already been submitted, as such, there is no chance of tempering with the evidence. Heard A.P.P. also.

Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai, in connection with Kajra P.S. Case No. 61 of 2018, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
