2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 109, 76, 329(4), 352 of the Bharatiya Nyaya Sanhita.

3. According to F.I.R., on 17.9.24 at about 6:05 PM, while informant was at her house, this petitioner misbehaved with her minor daughter and abused and dragged her due to which she became naked. It is further alleged that this petitioner also assaulted informant with fists and slaps, causing eye injury.

4. Learned counsel for the petitioner submits that dispute over pathway led to a simple occurrence of maar-peet. Case and counter case. Injuries sustained by the injured are simple in nature. Rest of the allegations are ornamental only to

5. Learned A.P.P. for the State as well as learned counsel for the informant vehemently opposed the bail application.

6. Considering the backdrop of the case, nature of accusation, simple injury and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, East Champaran, Motihari in connection with Mehsi P. S. Case No. 142 of 2024, subject to condition as laid down under Section 482(2) of the Bhartiya Nagarik Suraksha Sanhita, 2023.
