In this case, the petitioner is apprehending his arrest in connection with Nawada Town P.S. Case No. 160 of 2016 registered for offences under sections 419, 420, 467, 471, 120B of the Indian Penal Code and 3(x) of the Bihar Examination Act.
An allegation has been made against the petitioner that in his place, one Bhola Kumar gave examination of Matriculation of English paper at the center, namely, Seth Sagarmal Agrawal Mahila Mahavidyalaya, Nawada, who was nabbed and disclosed the name of the petitioner. Learned counsel for the petitioner submits that Bhola Kumar has already been granted regular bail by the
Patna High Court Cr.Misc. No.19003 of 2018(3) dt.20-04-2018 2/2 learned Sessions Judge vide B.P. No. 294 of 2016. Looking to the allegation made against the petitioner, this Court is not inclined to grant privilege of anticipatory bail to the petitioner.
Accordingly, the prayer for anticipatory bail of the petitioner, namely, Ravi Ranjan @ Ravi Ranjan Kumar is rejected.
Let the petitioner should appear before the court below within a period of four weeks from today and pray for bail and the court below will consider the same on the same day of his appearance taking into consideration that the petitioner is a Class-10 student and the fact that the person, who has appeared in his place, has already been granted bail by the court below itself.
