This application is for grant of regular bail in connection with Bhabua P.S.case No.340 of 2019 dated 16.6.2019 Sessions Trial No.240 of 2019 for the offences under Sections 147, 148, 149 and 302 of the Indian Penal Code. As per the FIR, petitioner and other accused persons stabbed the deceased indiscriminately causing his death. Submission of the learned counsel for the petitioner is that no specific allegation is attributed against the petitioner and moreover the informant does not appear to be eye witness of the occurrence. Petitioner is in custody since 16.7.2019.

Heard learned A.P.P. and the learned counsel for the informatn, who has opposed the prayer for bail on the

Patna High Court CR. MISC. No.84370 of 2019(3) dt.19-02-2020 2/2 ground that the petitioner and other two accused persons were carrying knife, which appears fro the statement of some of the witnesses and there are altogether ten incise wounds on the person of the deceased..

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner .

With the aforesaid observation, this application is dismissed.
