2. The petitioner apprehend his arrest in Kamtaul P.S. Case No. 216 of 2023 registered for the offences punishable under Section 420, 120(B)/34 of the Indian Penal Code and Sections 30(a), 32(i)(ii), 41(i) of the Bihar Prohibition and Excise Act-2016, pending in the Court of learned Exclusive Special Judge-I (Excise Act), Darbhanga.

3. After some arguments, learned counsel for the petitioner seeks permission to withdraw this application.

4. Permission is granted.

5. Accordingly, the instant application is dismissed as withdrawn. However, if the petitioner surrenders before the learned Court below within a period of six weeks from today

Patna High Court CR. MISC. No.3344 of 2024(2) dt.01-02-2024 2/2 and seeks regular bail, the learned Court below would pass the order, preferably, on the same day, without being prejudiced by this order.
