2. Learned counsel appearing on behalf of the petitioner seeks modification of the order dated 07.11.2023, passed in Cr. Misc. No.71373 of 2023 arising out of Excise Case No.773 of 2023 by which 4 weeks' time was granted to the petitioner to furnish bail bond and surrender before the District Court.

3. Learned counsel further submits that the order dated 07.11.2023 could not be communicated to the petitioner because the petitioner was out of the State, engaged in some other works in another State, as such the petitioner could not furnish the bail bond within time and just after the petitioner came to learn about the order dated 07.11.2023, he has filed the

Patna High Court CR. MISC. No.11281 of 2024(2) dt.13-03-2024 2/2 present modification application for extending the time to surrender and to furnish the bail bond before the District Court.

4. Considering the information given in the modification application and the affidavit, it is a fit case to modify the order dated 07.11.2023 on similar terms and conditions, as mentioned in the aforesaid order, and the time to surrender and furnish the bail bond is extended. The petitioner is directed to surrender before the District Court on or before 18.03.2024, as per his desire to comply with the direction and the condition as contained in the order dated 07.11.2023. In case of failure to comply with the direction of this Court, this order shall lose its force.

5. The order dated 07.11.2023 passed in Cr. Misc. No.71373 of 2023 is modified to the above extent only and other parts of the order shall remain intact.

6. Accordingly, the present modification application stands disposed of.
