The petitioner seeks bail in a case registered under Sections 399, 402, 414 of the Indian Penal Code and 25(1-b)A, 26, 35 of Arms Act.
Allegation is that pistol, cartridges and two stolen motorcycles are recovered.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 16.10.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The name of the petitioner has transpired in this case on the disclosure made by co-accused. No arms is alleged to have been recovered from the possession of the
Patna High Court CR. MISC. No.82855 of 2019(2) dt.13-12-2019 2/2 petitioner. The arms are alleged to have been recovered from the co-accused. Other co-accused have been granted bail vide Annexure P2 to the present application.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st class, Muzaffarpur in connection with Kathaiya P.S. case No.79 of 2019 (G.R.
