The petitioner seeks bail in Sessions Trial No.499 of 2018 arising out of Maniyari P.S. case No.48 of 2013 registered under Sections 302/34 of the Indian Penal Code and 27 of the Arms Act, pending in the court of Additional Sessions Judge IX, Mzuaffarpur.

The earlier bail application of the petitioner was rejected vide Annexure 2 to the present application taking into account that the petitioner is the main assailant. A report was called for from the trial court. It has been reported that charge has already been framed and the process has been issued against the prosecution witnesses and the trial is expected to be concluded within a period of six months.

Patna High Court CR. MISC. No.83844 of 2019(3) dt.04-03-2020 2/2 Considering the nature of accusation and the stage of the trial, I am not inclined to grant bail to the petitioner. The same is rejected.

The Trial Court is directed to take all necessary steps to conclude the trial preferably within a period of six months from the date of receipt/production of a copy of this order. The District Magistrate, Muzaffarpur and the Senior Superintendent of Police, Muzaffarpur are also directed to take necessary steps to produce the witnesses on the date fixed by the Trial Court so that the trial could be concluded within the stipulated period.

Let this order be communicated to the District Magistrate, Muzaffarpur and the Senior Superintendent of Police, Muzaffarpur.
