JUSTICE SANJAY PRIYA ORAL ORDER 12-04-2018 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Complaint Case No. 1081 of 2016, Trial No. 2155 of 2016 instituted for the offence under Sections 406, 420, 409 and 120B of the Indian Penal Code.

Learned counsel for the petitioner has submitted that co-accused Rajendra Kumar Pandit has been granted anticipatory bail by a coordinate Bench of this Court vide order dated 02.02.2018 passed in Cr. Misc. 5200 of 2018.

Learned counsel for the informant has appeared and submitted that co-accused Rajendra Kumar Pandit was granted anticipatory bail on the ground that this petitioner had taken

Patna High Court Cr.Misc. No.15223 of 2018 (2) dt.12-04-2018 2/2 money from the complainant and complainant entered into an agreement with the complainant which has been enclosed as Annexure-4, but petitioner did not return money to the complaint. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.

Prayer for anticipatory bail of the petitioner stands rejected.

Petitioner may surrender before the court bellow and make prayer for regular bail which will be considered by the court below in accordance with law without being prejudiced by this order preferably on the same day, if possible. (Sanjay Priya, J) S.Ali/- U T
