Petitioner is apprehending arrest in connection with Daudnagar P.S. Case No. 291 of 2019 for the offence under sections 420, 467, 468, 471, 483, 414 and 401 of the Indian Penal Code.
Learned counsel for the petitioner submits that petitionr has no criminal antecedent. The name of the petitioner surfaced in the instant case on the confessional statement of Dinesh Kumar Utpalkant who was arrested by the police alongwith stolen motorcycle.
Learned counsel submits that similarly circumstanced other co-accused Dipu Kumar and Lalu Kumar have been granted anticipatory bail in Cr. Misc. No. 66885 of
Patna High Court CR. MISC. No.82055 of 2019(2) dt.11-12-2019 2/2 2019 and Cr. Misc. No. 77279 of 2019 vide order dated 20.11.2019 and 27.11.2019.
Considering the fact that petitioner has no criminal antecedent and similarly circumstanced other coaccused have been granted anticipatory bail, the court is inclined to grant bail to the petitioner, let the petitioner, named above, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Daudnagar, Aurangabad, in connection with Daudnagar P.S. Case No. 291 of 2019 subject to the condition as laid down under section 438(2) of the Cr.P.C.
