The petitioner apprehends her arrest in Alamnagar P.S. case No. 3 of 2018 for the offences punishable under Section 406, 420 of the Indian Penal Code.
The gist of the allegation is that the petitioner, being Incharge of Customer Service Point of State Bank of India, Mathuwa Blagipur Panchayat, did not make payment of old age pension to the pensioners. It is alleged that petitioner paid only Rs. 5,000/- instead of Rs. 5,600/- to pensioners and no payment was made to two pensioners.
The learned counsel for the petitioner submits that money was withdrawn by the petitioners after submitting withdrawal form. Two petitioners had no account in customer
Patna High Court Cr.Misc. No.12539 of 2018 (2) dt.28-02-2018 2/2 service point of the petitioner. The pensioners have already filed affidavit that they had already withdrew the entire amount from their accounts.
Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner above named in the event of her arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub divisional Judicial Magistrate, Udakishunganj, Madhepura in connection with Alamnagar P.S. case No.3 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
