Mr.Parmeshwar Mehta ====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 13-02-2020 Heard learned Senior counsel assisted by Sri Mithilesh Kumar for the petitioners and learned APP for the State.

The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 406, 409, 420/34 of the Indian Penal Code.

Learned counsel for the petitioners submits that the fund allotted to the petitioners had been expended in the construction of work under 'Nal Jal Yojna' and the rest of money is still lying in the accounts. It is further submitted that no case of embezzlement has been made out and the allegation as per FIR is that the money which is lying in the account has

Patna High Court CR. MISC. No.82120 of 2019(2) dt.13-02-2020 2/2 not been refunded. The petitioners have no criminal antecedent. The co-accused have been granted anticipatory bail by the Coordinate Benches of this court vide order dated 11.12.2019 in Cr. Misc. No. 81907 of 2019 and order dated 18.12.2019 in Cr. Misc. No. 73880 of 2019.

In the aforesaid facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs. 20,000/- (rupees twenty thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Aurangabad in connection with Deo P.S. Case No. 73 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
