2. The petitioner apprehends his arrest in connection with Durgawati P.S Case No. 305 of 2024 registered for the offences punishable under Sections 30(a) of Bihar Prohibition and Excise Act.

3. As per the prosecution case, total 180 litre illicit liquor recovered from the open field.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. It is next submitted that petitioner is neither named in the F.I.R nor any incriminating articles were recovered from his possession.

5. Learned counsel for the State opposes the prayer

Patna High Court CR. MISC. No. 87386 of 2025(2) dt.19-12-2025 2/2 for bail of the petitioner.

6. From perusal of the F.I.R., impugned order and materials available on record it appears that petitioner is not named in F.I.R his name transpired in this case only on the basis of Call Detail Record and Tower location. Petitioner is not arrested on the spot.

7. Considering the aforesaid facts and circumstances of the case, submissions made on behalf of the petitioner, let the above named petitioner be released on bail in the event of his arrest or surrender before the trial court within a period of six weeks from today on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise-II, Kaimur at Bhabhua in connection with Durgawati P.S Case No. 305 of 2024 subject to the condition laid down under Section 482(2) of B.N.S.S, subject to the condition that petitioner shall co-operate in trial and if charge sheet has submitted against him then he shall physically present before trial court till conclusion of the trial.
