The petitioner is languishing in custody since 1.11.2019 in a case registered for the offences punishable under Sections 420,409 and 120B of the I.P.C. The prosecution case as per the self statement of Ranvir Kumar, SHO, Kudra Police Station, is to the effect that frequent information were received that on GT Road there are anti-social elements known as Entry Mafia and they are allowing the trucks loaded with sand to cross the Bihar boarder as they claim themselves to be close to the police and administration. Consequently, raid was laid at the boarder when the miscreants tried to escape from the scene but they were found collecting money from the truck

It is submitted by learned counsel for the petitioner that there is no recovery from the petitioner and only on the basis of suspicion the petitioner has been roped in the present case. Statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent and above all, no truck driver has made complaint about the collection of money and they are being cheated. Hence, no offence under Sections 420,409 and 120B of the IPC is made out. It is further submitted that co-accused Harimohan Yadav has been granted bail vide order dated 6.12.2019 passed in Cr. Misc. No. 80288 of 2019 by a Co-ordinate Bench of this Court.

Learned APP submits that the petitioner has been found to be active members of Entry Mafia.

Considering the suspicious nature of accusation, statement made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent, the investigation being concluded and the period in custody, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with
